आर्थिक आघार पर आरक्षण की कवायद कई बार हुई, लेकिन यह अंजाम तक नहीं पहुंच सकी थी। इस बार मोदी सरकार की रणनीति की रणनीति ने असर दिखाया। जो इसे प्रवर समिति को सौंपना चाहते थे, जो इसकव छलावा, धोखा, शिगूफा, राजनीतिक चाल बता रहे थे, उन सभी को विधेयक का समर्थन करना पड़ा। क्योंकि सरकार ने अपनी दूरदर्शिता से ऐसी परिस्थितियों का निर्माण कर दिया था, जिसमें तत्काल समर्थन या विरोध व्यक्त करने के अलावा कोई विकल्प ही नहीं था।विरोध का मतलब यह होता कि उसे सामान्य वर्ग के समर्थक की कोई आवश्यकता नहीं है। इसलिए सरकार पर हमले के बाबजूद विधेयक के पक्ष में मतदान किया गया। विरोध करने वाले अपवाद स्वरूप ही थे। इतना ही नहीं इस मसले का समाधान सौहार्द के साथ हुआ। इस पटकथा में केवल राजद के सदस्य, ओवैसी जैसे लोग ही खलनायक की भूमिका में दिखाई दिए। बिहार में कांग्रेस को इसी पार्टी के पीछे चलने को विवश रहेगी। राजद के सदस्यों ने जिस प्रकार इस विधेयक का विरोध किया उससे उंसकी सामान्य वर्ग विरोधी मानसिकता उजागर हुई है। उसके राज्यसभा सदस्य ने इसे मध्यरात्रि की डकैती बताया। कुछ लोग बोले कि सरकार आरक्षण समाप्त करना चाहती है।
लालू यादव ने इसी मानसिकता के साथ राजद की स्थापना की थी। तब लालू ब्राह्मण, क्षत्रिय, वैश्य, भूमिहार, वैश्य आदि के सफाए की बात करते थे। जातीय समीकरण बना कर उन्होंने बिहार में पन्द्रह वर्ष शासन किया। गठबन्धन राजनीति में आने के बाद उनकी जातीय नफरत की बोली में बदलाव हुआ। लेकिन एक बार फिर लालू उसी राजनीति पर लौट आये है। लालू ने विरोध के लिए राज्यसभा में एक ब्राह्मण नेता को लगाया, यही कार्य बसपा के द्वारा किया गया। ये दोनों राज्यसभा सीट की कीमत अपने स्वाभिमान से चुकाते नजर आए।
संविधान सभा में इस संबन्ध एक कमेटी बनाई गई थी। उसमें विचार विमर्श के बाद मतदान हुआ था। सात में से पांच वोट आरक्षण के खिलाफ पड़े थे।
मौलाना आजाद, मौलाना हिफ्ज-उर-रहमान, बेगम एजाज रसूल, तजम्मुल हुसैन और हुसैन भाई लालजी ने इसका विरोध किया था। डॉ. भीमराव आंबेडकर ने कहा था कि आरक्षण स्थाई व्यवस्था नहीं है। वह चाहते थे कि दस वर्ष में इसकी समीक्षा की जाए। यदि आरक्षण से किसी वर्गा का विकास हो जाता है तो उसके आगे की पीढ़ी को आरक्षण का लाभ नहीं देना चाहिए। आरक्षण का मतलब बैसाखी नहीं है, जिसके सहारे पूरी जिंदगी काट दी जाए। यह विकसित होने का एक मात्र अधिकार है।
इसीलिए डॉ आंबेडकर ने संविधान में आरक्षण की स्थाई के समर्थन में नहीं थे। वह अनुसूचित वर्ग को बराबरी का अवसर देने के साथ स्वाभिमानी भी बनाना चाहते थे। इस आधार पर कहा जा सकता है कि प्रमोशन में आरक्षण की मांग डॉ आम्बेडकर के विचारों के विरोध में है। क्योकि एक बार बराबरी पर आ जाने के बाद पुनः प्रमोशन में आरक्षण लेना सामाजिक न्याय की अवधारणा का उलंघन करने वाला है। इसके अलावा संविधान में आर्थिक आधार पर आरक्षण की कोई व्यवस्था नहीं थी। ऐसे में आर्थिक आधार पर आरक्षण के लिए संविधान के अनुच्छेद पन्द्रह और सोलह में संसोधन की आवश्यकता थी।
अनुच्छेद पन्द्रह समस्त नागरिकों को समानता का अधिकार देता है। इसके खण्ड एक अनुसार राज्य, किसी नागरिक के विरुद्ध केवल धर्म, मूलवंश, जाति, लिंग, जन्मस्थान या इनमें से किसी के आधार पर कोई विभेद नहीं करेगा। खण्ड चार व पांच में सामाजिक और शैक्षिणिक दृष्टि से पिछड़े वर्गों या अनुसूचित जाति और जनजाति के लिए विशेष उपबंध की व्यवस्था की गई थी। अनुच्छेद सोलह के खंड चार,उसके उपखंड, उपखंड पांच राज्य को अधिकार देते हैं कि वे पिछड़े हुए नागरिकों के किन्ही वर्गों को सरकारी नौकरियों में आरक्षण दे सकता है।
आर्थिक आधार पर आरक्षण देने की चर्चा और प्रयास पुराने है। लेकिन ये प्रयास सार्थक नहीं हुए। उन्नीस सौ इक्यानवे में पीवी नरसिंह राव सरकार ने आर्थिक आधार पर दस प्रतिशत आरक्षण देने का प्रस्ताव किया था। लेकिन सुप्रीम कोर्ट की नौ सदस्यीय पीठ ने उसे खारिज कर दिया था। उन्नीस सौ बानवे में सुप्रीम कोर्ट में आरक्षण की सीमा पचास प्रतिशत निर्धारित कर दी थी। दो हजार तीन में भाजपा सरकार ने आर्थिक आधार पर विचार हेतु एक मंत्री समूह का गठन किया था। लेकिन इसके अगले वर्ष चुनाव में भाजपा सरकार की सत्ता में वापसी नहीं हो सकी थी।
दो हजार छह में यूपीए सरकार ने पुनः एक समिति बनाई थी। उंसकी रिपोर्ट भी आ गई। लेकिन वह इसे अंजाम तक पहुंचाने में विफल रही।
यह विचित्र था कि कांग्रेस ने आरक्षण को लेकर सरकार पर हमला भी बोला। उसका कहना था सरकार इसे पहले लेकर क्यों नहीं आई। जबकि कांग्रेस ने आर्थिक आरक्षण पर रिपोर्ट आने के बाद भी कोई कारगर कदम नही उठाया था। वर्तमान सरकार ने इर पर व्यापक विचार किया।
वह पूरी तैयारी के साथ यह संविधान संसोधन लाई। यह आरक्षण केंद्रीय और प्रांतीय सरकारी नौकरियों में एक साथ लागू होगा। अनुच्छेद सोलह में नया खण्ड जुड़ेगा, जिसमें आर्थिक रूप कमजोर वर्ग को आरक्षण का प्रावधान होगा। यह भी समझना होगा कि आरक्षण का विषय संविधान के मूल ढांचे से संबंधित नहीं है। यहां तक कि भीमराव आंबेडकर इस प्रावधान को अस्थाई मानते थे। अस्थाई प्रावधान किसी संविधान के मूल ढांचे में शामिल नहीं होते। संसद की बहस में भी कुछ लोगों ने इसे मूल ढांचे के विरुद्ध करार दिया था। जबकि ऐसा कहना उचित नहीं था।
इतना तय है कि यदि नरेंद्र मोदी प्रधानमंत्री न होते तो आर्थिक आरक्षण कानून नहीं बन सकता था। यह मोदी की इछशशक्ति का परिणाम है। यह सही है कि सभी पार्टियों ने अपने हिसाब से राजनीतिक लाभ उठाने का भी प्रयास किया। कांग्रेस इसे टालना चाहती थी। वह समझ गई थी विधेयक पारित होने का लाभ भाजपा को मिलेगा। लेकिन प्रवर समिति को सौंपने की माग पर अड़ नहीं सकती थी। क्योंकि इससे सशोधन न होने का ठीकरा कांग्रेस पर ही फूटता।
इसलिए वह सरकार को कोसती भी रही और बिधेयक पारित कराने में सहयोगी भी बनी। राजनीति के तहत ही रोजगार को लेकर सरकार पर हमला बोला गया। ऐसी बातों से सरकार को अपनी उपलब्धिया गिनाने का अवसर मिला। अबतक ग्यारह करोड़ लोग मुद्रा योजना का लाभ ले चुके है। शौचालय, निर्धनों को आवास, सड़क, रेल लाइन के निर्माण में मोदी सरकार ने रिकार्ड उपलब्धि हासिल की है। उज्ज्वला, आयुष्मान, योजना भी बेजोड़ है। अब सामाजिक न्याय को भी मोदी सरकार ने मजबूत बनाया है।
